1. Acceptance of These Terms
By creating an account, accessing, or using L.O.S Farms (the "Service"), you agree to be bound by these Terms of Service ("Terms"), the User Agreement, and the Privacy Policy, each of which is incorporated into these Terms by reference. If you do not agree to all of these documents, do not use the Service.
If you are under 18, please also review the age requirement in Section 3.
2. What L.O.S Farms Is
L.O.S Farms is an unofficial, non-commercial, fan-operated project that recreates and preserves the original Flash-based version of FarmVille, a game originally created and published by Zynga Inc. L.O.S Farms:
- is not affiliated with, endorsed by, sponsored by, or officially connected in any way to Zynga Inc., Take-Two Interactive Software, Inc., Meta Platforms, Inc. (Facebook), or any of their subsidiaries, affiliates, or successors in interest;
- does not charge for access, does not sell virtual currency or items for real money, and does not accept donations or any other real-world payment in connection with the Service;
- is operated as a hobby/preservation project, using original game assets and data for purposes of historical preservation and nostalgia, without a license from the original rights holders.
All trademarks, service marks, trade names, game content, artwork, and other intellectual property associated with "FarmVille" belong to their respective owners. Nothing in these Terms or your use of the Service transfers or grants you any right, title, or interest in that intellectual property.
3. Eligibility
You must be at least 13 years old to create an account. If you are a minor in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13; see the Privacy Policy for more detail.
4. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You agree to provide accurate information during registration and to keep it reasonably up to date.
- You may not create an account using another person's identity, impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- One account per person. Creating multiple accounts to evade a ban, suspension, or capacity limit is prohibited.
- Linking a Discord account is optional except where a specific feature requires it, and is separately governed by Discord's own Terms of Service and Privacy Policy, which we do not control.
5. Acceptable Use
You agree not to:
- harass, threaten, defame, or abuse other users or staff;
- upload, post, or transmit any content that is unlawful, obscene, hateful, or infringes another person's rights;
- exploit bugs, glitches, or unintended behavior for personal advantage, or use macros, bots, scripts, or automation tools not explicitly provided by us (our own Discord bot mini-games are the only sanctioned automation);
- attempt to gain unauthorized access to any account, system, or data, or interfere with the normal operation of the Service;
- reverse engineer, decompile, or attempt to extract source code from the Service except to the extent such restriction is prohibited by applicable law;
- use the Service for any commercial purpose without our prior written consent.
We may, in our sole discretion and without prior notice, remove content, restrict features, or suspend or terminate any account that we believe violates these Terms, harms other users, or harms the Service — see Section 8.
6. User-Generated Content
The Service allows you to post forum messages, chat messages, a profile avatar, a forum signature image, and similar content ("User Content"). You retain whatever ownership rights you may have in your own original User Content, but by submitting it you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display it as necessary to operate the Service.
You are solely responsible for your User Content. We do not pre-screen User Content, but we may review, edit, refuse to post, or remove any User Content at any time, for any reason, without notice.
Do not post User Content that infringes someone else's intellectual property rights. If you believe content on the Service infringes your rights, contact us at [CONTACT EMAIL] with enough detail for us to locate and evaluate it; we will act in good faith to address legitimate reports.
7. No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DATA — INCLUDING YOUR ACCOUNT, FARM, VIRTUAL ITEMS, OR PROGRESS — WILL BE PRESERVED OR AVAILABLE AT ANY FUTURE TIME.
This is a hobby project maintained on a best-effort basis. It may go offline, be reset, lose data, or be discontinued at any time, with or without notice, for any reason, including but not limited to the reason described in Section 9.
8. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for suspension or termination include, without limitation, violation of these Terms or the User Agreement, suspected fraud or abuse, or a request from a rights holder described in Section 9. You may stop using the Service, and may request deletion of your account and associated data, at any time through your profile settings or by contacting us.
Sections 2, 6 (as to content already licensed), 7, 8, 9, 10, 11, and 13 survive termination.
9. Discontinuation at a Rights Holder's Request
Because the Service uses original FarmVille game assets, code, and branding without a license from Zynga Inc., Take-Two Interactive Software, Inc., or any other rights holder, we may suspend, disable, or permanently shut down all or part of the Service immediately and without prior notice if we receive a takedown request, cease-and-desist, or similar demand from a rights holder, or if we otherwise determine in our sole discretion that continued operation creates unacceptable legal risk. Because the Service is free and non-commercial, no refund, compensation, data export guarantee, or other remedy is owed to you in that event, or in the event the Service is discontinued for any other reason.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR OPERATORS, CONTRIBUTORS, OR VOLUNTEERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR VIRTUAL ITEMS OR CURRENCY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO ZERO DOLLARS ($0).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless the operators of L.O.S Farms and its contributors from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of your use of the Service, your User Content, or your violation of these Terms.
12. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will update the "Last updated" date above and, where practical, post a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law and Disputes
